Terms of Service

These Terms of Service ("Terms") govern your use of Safyan, a product of AQ Holdings Inc. ("we," "us," "our"). By creating an account or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using Safyan — including the web application, Chrome extension, and API — you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. Account Registration

To access most features, you must create an account with a valid email address and password. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.

You must provide accurate information and promptly update it if it changes. We reserve the right to suspend or terminate accounts that use false information.

3. Acceptable Use

You agree not to:

• Use Safyan for any illegal or unauthorized purpose
• Attempt to bypass rate limits, authentication, or security measures
• Submit prompt injection attacks or attempt to manipulate the translation system
• Scrape, crawl, or automate access to the Service beyond the provided API
• Resell, redistribute, or white-label the Service without written permission
• Upload malware, viruses, or any harmful content
• Use the Service to generate content that is illegal, harmful, or violates the rights of others

Violation of these rules may result in immediate account termination without refund.

4. Service Tiers and Rate Limits

• Free tier: 10 translations per day. No credit card required.
• Pro tier: Unlimited translations, Chrome extension, priority AI models. Billed monthly.
• Lifetime tier: One-time payment for permanent Pro access.

We reserve the right to adjust rate limits and features for any tier with reasonable notice. Abuse of free-tier limits (e.g., creating multiple accounts) may result in termination.

5. Payment and Billing

Paid subscriptions are billed through Stripe. By subscribing, you authorize us to charge the payment method on file. Pro subscriptions renew automatically unless cancelled before the renewal date.

Refunds are handled on a case-by-case basis. Lifetime purchases are non-refundable after 14 days of purchase. If you believe you were charged in error, contact us.

6. Intellectual Property

Your content: You retain all rights to the text you input and the translations you receive. Safyan does not claim ownership of your input or output.

Our content: The Safyan name, logo, design, code, and translation algorithms are the intellectual property of AQ Holdings Inc. You may not copy, modify, or reverse-engineer the Service.

7. Disclaimers

Safyan is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that translations will produce specific results from any AI model.

AI models are third-party services with their own terms and limitations. Safyan translates your intent into structured prompts but does not control or guarantee AI model outputs.

8. Limitation of Liability

To the maximum extent permitted by law, AQ Holdings Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of profits, data, or business opportunities.

Our total liability for any claim shall not exceed the amount you paid to us in the 12 months preceding the claim, or $100 CAD, whichever is greater.

9. Termination

You may delete your account at any time by contacting us. We may suspend or terminate your account if you violate these Terms, with or without notice.

Upon termination, your right to use the Service ceases immediately. We may retain anonymized, aggregated data for analytics purposes.

10. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email or a prominent notice on the Service. Continued use after changes constitutes acceptance.

11. Governing Law

These Terms are governed by the laws of the Province of Quebec, Canada, without regard to conflict of law provisions. Any disputes shall be resolved in the courts located in Montreal, Quebec.
